Participation and Payment Conditions for Events organized by Shattered Horizons Orga

The contracting parties are the participating individual, hereinafter referred to as the “participant,” and Shattered Horizons Orga, hereinafter referred to as the “organizer.”

The subject of the contract is participation in a live role-playing event (LARP), where each participant portrays a fictional character.

The contract is concluded by the participant’s registration and confirmation by the organizer.

The organizer is only obligated to provide the organizational framework, not a specific course of action or specific set designs. There is no entitlement to the appearance of non-player characters (NPCs) against the organizer.

The participant is aware of the nature of the event and the associated risks (night hikes, terrain walks, fights with padded weapons, etc.).

The participant assures, with due consideration of the expected physical, mental, and emotional stresses, to be physically and mentally capable of participating in the event. If the expected stresses are not evident in the provided information material, it is the participant’s responsibility to seek further information from the organizer if in doubt.

The minimum age for participation in the event is generally 18 years. Exceptions to this rule are only permissible after consultation with the organizer and explicit confirmation via email.

The participation and payment conditions apply to the entire stay on the event premises, including the setup and dismantling phases before and after the actual gameplay.

All side agreements and amendments require written form. They become effective only after written confirmation by the organizer.

In the event of the ineffectiveness of individual provisions, the most permissible regulation that corresponds to the spirit of the invalid provision or comparable legal regulations shall apply.

The effectiveness of the remaining conditions is not affected by the ineffectiveness of individual parts of these regulations.

The participation and payment conditions of the organizer and the laws of the Federal Republic of Germany apply. Participants must comply with the instructions of the organizer and their agents.

The place of jurisdiction is Nuremberg.

Security

The participant undertakes to independently inform themselves about the applicable safety regulations of the organizer and continuously check their complete equipment for safety during the event. This includes armor, all types of padded weapons, and in-game firearms.

The participant commits to avoiding, if possible, dangerous situations for themselves, other participants, and the environment. This includes climbing on unsecured steep slopes and walls, igniting open fires outside designated fireplaces, using unsafe weapons or equipment, and excessive alcohol consumption.

Upon the organizer’s, legal representative’s, or agent’s order, the participant agrees to undergo a rapid test for infection with the “SARS-CoV-2” virus or comparable, if deemed necessary. Participation with concurrent infection may be declined by the organizer, with no entitlement to a refund of the participant fee in this case.

Participants violating safety regulations, endangering others, or not following the organizer’s instructions in a serious manner may be expelled from the event without the organizer being obligated to refund the participant fee.

Accommodation, Faction Locations, and Sanitary Facilities

Accommodation is based on the purchased ticket type.

Shared rooms: Accommodation is provided in 3 to 8-person rooms with bunk and single beds, similar to the standard of a youth hostel. Participants need to bring their own beddings (sheets, blankets, and pillowcases). If a sleeping bag is used, a bedsheet is still mandatory.

Dormitory: Accommodation is in rooms with a capacity of 10 to 20 people. Participants must bring their own camping beds and sleeping gear.

Tent: Accommodation is in personal tents. It is expressly recommended to familiarize oneself early with the climate conditions of the event location (Rhön, above 600 meters altitude) and plan accordingly.

The organizer assigns shared rooms and dormitories, but participants have the freedom to choose beds or spaces within the rooms (according to the setup plan).

Participants are required to leave the rooms broom-clean after dismantling. The same applies to function and faction rooms provided for gameplay; these must be handed over to a representative of the organizer after dismantling and cleaning.

Participants are provided with toilet, shower, and washing facilities. Depending on the local conditions, some of these rooms may be designated as dressing rooms for alien performers, providing them with an easier preparation option. After using the sanitary facilities, participants must leave them tidy and clean.

Participants are responsible for any damages resulting from improper use, especially careless handling of makeup, colors, etc., in and around the premises.

 

Liability

The organizer is not liable for the consequences of force majeure, including orders from authorities, civil unrest, terrorist attacks, fire, floods, power outages, accidents, storms, strikes, lockouts, or other labor disputes affecting the event.

Furthermore, the organizer is only liable for damages that are not damages resulting from injury to life, body, or health in cases of intent or gross negligence, liability for assumed guarantees, and liability for the violation of contractual obligations that are essential for the purpose of the contract or whose fulfillment is a prerequisite for proper contract fulfillment, upon which the participant regularly relies and should be able to rely on the organizer fulfilling these obligations (essential contractual obligations). In the case of negligent violation of essential contractual obligations that does not constitute gross negligence, the liability of the organizer is limited to the compensation of the foreseeable damage at the time of contract conclusion.

The organizer, its legal representative, or agents cannot be held liable for damages caused by unidentified third parties.

The respective causer is liable for self-inflicted damages. Participation in the event is only possible with existing liability insurance.

Driving on the premises and parking with own vehicles of any kind is at the participant’s own risk. The organizer is not liable for damages caused by third parties unrelated to the organizer. The event parking is not supervised, and theft is not covered.

Copyright and Recordings

All rights to sound, film, and video recordings remain reserved by the organizer.

The participant expressly agrees to the (public) utilization and use of image and sound material depicting or affecting them. This applies spatially and temporally without restrictions, especially for commercial exploitation.

Recordings by participants are only permissible for private purposes.

Any public performance, transmission, or reproduction of recordings, even after editing, is only permissible with the prior written consent of the organizer.

All rights to the storyline and the ensemble of terms and proper names used by the organizer are reserved.

Withdrawal, Non-Acceptance of Registration, Exclusion from the Event

The participant numbers for certain factional roles are limited by the organizer; registrations exceeding the factional limit may be rejected. There is no entitlement to participation.

The number of participants is limited. The organizer reserves the right to exclude participants from the event in advance with a refund of the participant fee if there is reason to believe they will jeopardize the planned course of the event. This includes disturbing the event, excessive alcohol consumption, grossly offensive behavior, non-compliance with game rules or organizer instructions, commission of legal offenses, or portrayals that grossly contradict the intended character of the event.

Purchased tickets are generally not refundable. The rules on distance contracts according to § 312b Abs. 3 Nr. 6 BGB do not apply to ticket purchases. This means that there is no two-week right of withdrawal and return.

In case of non-appearance at the event (regardless of the reasons), the participant fee will not be refunded.

The organizer is entitled to withdraw from the contract for a significant reason, especially if a minimum number of 50 participants is not reached, or the execution of the event is unreasonable due to the economic sacrifice threshold being exceeded due to circumstances beyond its control.

Participant slots are transferable with the organizer’s consent. Excluded from this are all NPC (non-player character) cards. Transfer to participants with a confirmed and fee-paying registration is not possible.

A participant acquiring an NPC card must strictly follow the instructions of the authorized persons of the organizer regarding the actions to be performed and the respective character portrayal at the event. Exemptions include reasons such as physical exhaustion, injury, etc., as well as moral reservations. In case of non-compliance, a contractual penalty of at least the difference between NPC and PC (player character) card is due. The NPC participant is allowed to provide evidence of no or lesser damage. The NPC participant is not obligated to participate in organizational tasks of the organizer.

Participant Fee, Default of Payment

The participant fee is generally payable in advance. If payment is not made by the event date, a flat processing fee of €10 is agreed upon. The right of the organizer to claim actually incurred, higher expenses against proof remains unaffected.

After the conclusion of the contract, the due amount is to be transferred within two weeks.

Processing of Personal Data

For registration, we use Google Forms. By using it, you agree to all associated transmissions and storage in accordance with Google’s privacy policy. We use your data solely for registration management, do not disclose it to others, and delete it within 3 months after the event.
